Misdemeanor Lawyer in Long Beach, Los Angeles & Orange County
Being charged with a misdemeanor, or any crime, can be devastating and cause friction within your family structure. In California, there are three levels of offenses: felonies, misdemeanors, and infractions. A misdemeanor conviction does not carry the possibility of a prison sentence, but people who are convicted may spend time in county jail and put on probation for several years. Common misdemeanors in California include driving under the influence, domestic battery, petty theft, lewd conduct, and trespassing. While misdemeanors won’t result in extensive prison time, they will appear on criminal background checks so it’s imperative that you obtain an experienced lawyer who can advocate for you.

What to Expect From your Misdemeanor Case
Misdemeanors can affect anyone, regardless of their age, gender, or financial status. Fortunately, within the judicial system a misdemeanor is actually a lesser evil because a conviction does not carry the possibility of a prison sentence, but they do carry the potential of time in jail. Standard California misdemeanors are punishable by up to six months in jail and/or a fine of $1000. Aggravated misdemeanors are punishable but up to 364 days in jail and of up to $1000 or more.
FAQs About California Misdemeanors
What crimes are misdemeanors?
Examples of misdemeanor offenses include petty theft, public intoxication, simple assault, disorderly conduct, vandalism, trespassing, and reckless driving.
Will my misdemeanor case go to court?
In any crime case, even one that’s a misdemeanor, you will be arraigned and have to enter a plea of guilty or not guilty. Afterward, you and your defense team will accept the court’s ruling by executing the penalty or deciding to fight it in a trial.
Should you disclose a misdemeanor on a job application?
Usually, most job applications only inquire about the status of felony convictions. Others may ask about convictions for a certain period of time, like seven to ten years.
Do misdemeanors disappear from your record in California?
Not really. You may have a summary probation period of one to three years, but you must file for expungement for it to disappear from your record.
